A man who was convicted of rape and subsequently avoided a prison sentence is now having his conviction reviewed after prosecutors admitted to making mistakes during his trial. Sean Hogg, at the age of 22, was found guilty of raping a 13-year-old girl on multiple occasions in Dalkeith Park, Midlothian back in 2018, when he was only 17 years old. Surprisingly, Hogg was spared jail by Judge Lord Lake at the High Court in Glasgow and instead was given a community payback order with 270 hours of unpaid work, citing new guidelines for sentencing individuals under 25. However, this decision caused widespread outrage, with many criticizing it as a “total insult to the victim in this case”, according to shadow Scottish justice secretary Jamie Greene.
Judge Lord Lake admitted that if Hogg had been over the age of 25, he would have imposed a prison sentence ranging from four to five years. This revelation only added fuel to the fire of the public’s outrage. The severity of the sentence had many questioning the message it sent out to both victims and potential offenders. It raised concerns about the adequacy of the justice system in delivering fair and appropriate punishment for such serious crimes. Additionally, the judge’s comments inadvertently undermined the seriousness of the crime itself, which further deepened the anger felt by those affected by sexual violence.
Appeal and Legal Errors
Following the controversial sentence, Sean Hogg claimed he was wrongfully convicted and subsequently appealed the decision. Simultaneously, the Crown Office announced its intention to challenge the sentence as being “unduly lenient”. Now, Scotland’s most senior judges will review the case to determine whether the conviction should be quashed due to the presence of legal errors during the trial. The Court of Criminal Appeal in Edinburgh was informed that both the advocate depute and the trial judge had failed to push for further details or provide adequate instructions to the jury. Solicitor General Ruth Charteris KC admitted that “mistakes were made at the trial” and highlighted three main issues: the direction given to the jury regarding distress, an error in the instructions, and the verdict delivered by the jury. One crucial factual error made by the judge was referencing the girl’s distress in one of the incidents where no evidence of penetration by Hogg was presented, undermining the credibility of the judge.
During the appeal hearing, Judge Lord Matthews expressed concerns about the quality of the evidence and stressed the importance of ensuring a fair trial. He described some of the evidence presented as “worthless” and emphasized the strong public interest in upholding fairness and justice in every legal proceeding. Donald Findlay KC, who represented Sean Hogg, called the conviction a “miscarriage of justice” and strongly asserted that the verdict should not have been allowed to stand. Aamer Anwar, the legal representative for the victim – now 18 years old – stated that his client was devastated by the outcome and strongly believed in the justice system’s duty to uphold the truth. Despite the mistakes made during the trial, Anwar emphasized the importance of the evidence provided, asserting that it was still sufficient to convict Hogg of raping the girl on at least one occasion.
The review of this controversial rape conviction raises serious questions about the impartiality and effectiveness of the justice system. As the Senior judges examine the case for legal errors that may have influenced the outcome, it is imperative to ensure fairness for all parties involved. Ultimately, the focus should remain on the victim and the pursuit of justice, allowing the truth to prevail and sending a clear message that the courts prioritize the safety and well-being of survivors.
