Non-compliance with the rules can result in fines of up to 6% of companies’ global annual revenues. However, the threat of penalties from the U.S. government is perceived as riskier, requiring officials to approach requests explicitly and without the suggestion of enforcement actions or penalties. The letters from New York Attorney General Letitia James to social media sites serve as an example of the delicate line U.S. officials tread, seeking information without threatening punishment for non-compliance.

While social media companies have adapted to various speech restrictions in different countries, they may choose to confine new policies to Europe. The tech industry has previously implemented policies like the EU’s General Data Privacy Regulation (GDPR) on a broader scale, so it is not implausible for them to adopt similar measures worldwide.
