SpaceX recently conducted a “full-pressure test” of its new flame deflector system at the Starship Super Heavy launch site in South Texas. However, it has come to light that the company never obtained the necessary environmental permits to discharge industrial process wastewater into the surrounding area. This omission puts SpaceX in potential violation of the federal Clean Water Act.

The flame deflector, also known as a water deluge system, serves as a crucial component to diffuse heat, sound, and energy generated during orbital test flights and launches of SpaceX’s largest rocket. CEO Elon Musk envisions this rocket as a means of transporting humans and equipment to the moon and, ultimately, to Mars.

Environmental Concerns

Despite the significance of the flame deflector system, SpaceX has not disclosed crucial information about its water usage, runoff destination, or contents. The Starbase facility, located along the Gulf of Mexico in Texas, is surrounded by wetlands that are vital for migrating and nesting endangered species. Additionally, these wetlands hold cultural importance for the indigenous population. The discharge of wastewater without a thorough understanding of its environmental impact is a cause for concern.

According to the Texas Commission on Environmental Quality (TCEQ), SpaceX has not applied for a Texas Pollutant Discharge Elimination System (TPDES) permit at the Starbase facility. Although the site has obtained stormwater permits in the past, the responsibility to determine the need for a discharge permit lies with the business owner. TCEQ confirms that discussions regarding industrial permitting have taken place with SpaceX.

SpaceX has not provided any explanation for proceeding with the test without obtaining the necessary permit. Requests for comment have gone unanswered. It is crucial for companies to comply with environmental regulations, particularly when it comes to managing wastewater and its potential impact on surrounding ecosystems.

Industrial process water, such as that used in the flame deflector system, is considered a regulated pollutant under the Clean Water Act. The presence of heat, silt, and other chemicals in wastewater can degrade the biological integrity of wetlands and harm water quality in the long term. Permits are required to ensure proper treatment and safe disposal of industrial wastewater. Violations of environmental laws can lead to criminal enforcement actions, including fines and imprisonment.

Previous Incidents and Lawsuit

SpaceX’s previous test flight at the Boca Chica site resulted in an explosion and scattered debris, causing damage to nearby sensitive habitats. In response, the Federal Aviation Administration (FAA) grounded the Super Heavy launch program until a thorough investigation was conducted. This incident also sparked a lawsuit against the FAA, highlighting concerns regarding the environmental impacts of SpaceX’s operations in Texas and the lack of transparency.

Environmental advocates have expressed concern about the lack of transparency and public input. Jared Margolis, senior attorney with the Center for Biological Diversity, states that changes to the launch site and launch procedures have been made without proper disclosure or an opportunity for public comment, as required by the National Environmental Policy Act. The FAA, while acknowledging that the Boca Chica site is not licensed by them, maintains that SpaceX still holds a vehicle operator’s license.

The Texas Commission on Environmental Quality is currently evaluating the pressurized water system utilized in SpaceX’s launch operations to determine if state environmental regulations have been violated. No firm conclusions have been reached regarding potential breaches of environmental laws.

SpaceX’s decision to proceed with a test at the Starship Super Heavy launch site without the necessary environmental permits raises concerns about its compliance with regulatory requirements. The discharge of industrial process wastewater into surrounding areas without proper oversight poses risks to ecosystems and could lead to legal ramifications. Transparency and adherence to environmental regulations are essential for responsible space exploration and protection of natural habitats.
