The Origin of the Clash

The clash between Disney and DeSantis began last year when Disney publicly opposed a controversial classroom bill in Florida that restricted discussions on gender identity and sexual orientation. DeSantis and his GOP-led Legislature responded by attempting to dissolve Disney World’s special district, an entity that had allowed the company’s Orlando-area parks to govern their operations autonomously since the 1960s. Ultimately, the district remained intact, but it was renamed the Central Florida Tourism Oversight District (CFTOD) and its board of supervisors was replaced with individuals handpicked by DeSantis himself.

Before the new board assumed control, Disney secured development deals to safeguard its investments in the region. However, DeSantis’s appointed board accused Disney of undermining its authority. The board voted to void the development deals in April, prompting Disney to file a federal lawsuit against DeSantis, alleging that he was abusing his government power. In response, the CFTOD board countersued in state court.

On Friday, Judge Margaret Schreiber made a pivotal ruling that the dispute over Disney’s contracts must be resolved by a court of competent jurisdiction. She emphasized that the issue has real-world consequences for both parties and remains unresolved. Disney had requested the dismissal of the state lawsuit, arguing that it was moot due to additional legislation signed by DeSantis that invalidated the company’s development contracts. However, the judge disagreed, paving the way for the state-level case to proceed.

The battle between Disney and DeSantis extends beyond the legal arena. As a prominent contender for the 2024 Republican presidential nomination, DeSantis has employed rhetoric aligned with conservative cultural warfare against what he perceives as “woke” issues.
